1. SUBJECT SCOPE
These regulations define the rules for purchasing goods from the Seller - Jolmie.co.uk.
2. GENERAL PROVISIONS
1. The Regulations are continuously available on the jolmie.co.uk website in a way that allows each user to obtain, reproduce and record its content by printing or saving on a carrier at any time.
2. The administrator of personal data processed in connection with the implementation of the provisions of the Regulations is the Seller. Personal data is processed for the purposes, to the extent and on the basis of the principles set out in the Privacy Policy published on the Website.
3. The Seller declares that it complies with all rules of personal data protection of customers.
4. Providing personal data is voluntary. Each person whose personal data is processed by the Seller has the right to inspect their content and the right to update and correct them.
5. The Customer agrees to the collection, storage and processing of personal data by the Seller for the purposes directly related to the implementation of the Goods ordered on the Website. Detailed conditions for the collection, processing and protection of personal data by the Seller are set out in the Privacy Policy of the Website.
6. The Customer is obliged to use the Website and the services offered by the Seller through it in a manner consistent with the provisions of the Regulations, the principles of social coexistence, bearing in mind the respect for personal rights as well as copyrights and intellectual property of the Seller and third parties. It is forbidden for the user or the customer to provide illegal content.
7. Using the Website means any activity of the Client which leads to the Client becoming familiar with all the content posted on the Website.
8. Promotions of the Goods organized via the Website may not be combined, unless the regulations of a given promotion state otherwise.

3. GLOSSARY
The expressions used in these Regulations mean:
Customer - consumer within the meaning of art. 22 point 1 of the Civil Code, who purchases goods from the Seller.
Seller - Jolmie, EMES SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ SPÓŁKA KOMANDYTOWA with its registered office in Lublin (postal code 20-601) at ul. Tomasza Zana 11A, NIP 7123453168, REGON 524978929, KRS 0001029932 (If you want to withdraw from the sales contract CONTACT to know the address for returns. Please do not return the goods to the following address: Tomasza Zana 11A, 20-601 Lublin. The shipment will not be accepted.)
Amount due to the Seller - the amount including the price of the product and transport costs.
Consumer Rights Act - the Act of 30 May 2014 on consumer rights (Journal of Laws, item 827, as amended).
VAT - tax on goods and services levied on import in accordance with the Act of March 11, 2004 on tax on goods and services (Journal of Laws 2016.710 ct).
Business day - one day from Monday to Friday, excluding public holidays.
Contact form - an interactive form enabling customers to contact the Seller.
The order form- an interactive form available on the Intermediary's website that allows placing an Order, in particular by adding the Goods to the electronic basket and defining the terms of the Agreement.
Goods - movables available on the website that are the subject of the Intermediation Agreement concluded between the Customer and the Seller.
Distance contract - contract concluded between the Intermediary and the Customer as part of an organized system of concluding distance contracts, without the simultaneous physical presence of the parties, with the sole use of one or more means of distance communication up to and including the conclusion of the contract.
Sales contract - a contract concluded between the Customer and the Seller as part of an organized system of concluding distance contracts, without the simultaneous physical presence of the parties, with the sole use of one or more means of distance communication up to and including the conclusion of the contract.
Electronic service - a service provided electronically by the Agent via the Website.
Order - the Customer's declaration of will submitted via the Website, using the Order Form, aimed at concluding the Intermediation Agreement, specifying in particular its conditions, as well as the type and quantity of the Goods, the method and cost of delivery, the form of payment and the Customer's data necessary to perform the contract.
Website - the Seller website available at jolmie.co.uk.
Payment method - the method of payment selected by the Customer: Stripe (Card Payments), PayPal.
4. OBLIGATIONS OF THE PARTIES
The Seller hereby declares that in connection with the provision of brokerage services in the sale of goods from foreign sellers, the Seller takes over some of the obligations under Polish law, incumbent on sellers of goods:
a) provides the Customer with the necessary information as well as coordinates the process in in the scope of the right to withdraw from the sales contract,
b) conducts and recognizes the complaint procedure regarding the goods,
c) is liable under the warranty for defects in the goods,
d) provides, at the customer's request, the instructions for use of the goods, and all necessary documents related to the goods in Polish.
5. THE AVAILABILITY OF SERVICE
1. The customer places an order via the website or contact form.
2. After receiving the order instruction, the Seller sends to the Customer:
a) confirmation recorded on a durable medium,
b) information that, in accordance with the Act on Consumer Rights, in order to perform the brokerage service within 14 days from the date of concluding the contract, it is necessary to record the Customer's request in this regard on a durable medium,
3. The Seller will provide the Customer with full information about the final price of the service along with all costs and a description of the main features of the service. The information is available on the Seller's website.
4. When placing an order via the Seller's website, the Customer provides the following data in the Seller's form: name, surname, e-mail address. delivery address, phone number.
5. The customer places an order after reading these Regulations and accepting its provisions.
6. The Seller is obliged to provide the Customer with a confirmation of the conclusion of a distance contract on a durable medium within a reasonable period of time after its conclusion, before the commencement of the service. This confirmation contains information about the main features of the service, including the subject of the service and the method of communication with the consumer.
7. The Seller starts the execution of the order after receiving payment for the service from the Customer.
6. DELIVERY OF GOODS
1. The ordered goods are delivered to the address provided by the Customer when placing the order.
2. The Seller declares that the delivery of the ordered goods will be carried out by the Seller within 60 working days from the date of conclusion of the sales contract.
3. Shipments are sent from outside the European Union by the Seller. The customer is an importer. It is the customer who is liable for import tax.
5. The consumer receives from the Seller information about the dispatch of the shipment and the shipment number, which enables its tracking. Each shipment is a registered shipment.
6. The customer is obliged to report the lack of delivery of the shipment no later than 100 days from the date of sending the shipment.
7. PAYMENT
1. Payment of the value of the order referred to in sec. 3 below, takes place on the basis of a prepayment before the start of the order by the Seller.
2. Payment can be made, at the Customer's choice, via PayPal or by payment card (Stripe).
3. The value of the order of a given product each time consists of the amount due to the Seller and the commission due to the intermediary.
4. All prices on the Seller's website are expressed in the selected currency.
5. At the Customer's request, the Seller issues a VAT invoice. The seller issues an invoice without the customer's signature and sends it to the customer electronically, to which the customer agrees.
8. RETURN OF GOODS BY THE CUSTOMER
1. Within 14 calendar days from the date of receipt of the goods, the Customer may submit a statement to the Seller about returning the goods purchased from the Seller, which is tantamount to withdrawal from the contract. Each time after receiving such a statement, the Seller will confirm to the Customer the fact of receiving the statement and the correctness of the address.
2. The Seller, within 14 days from the date of receipt of the declaration of return of the goods, if within this time he receives to the Seller's address proof of its return or return of the goods by the Seller, he will return the payment made by the Customer, i.e. the sum of the amount that was transferred to the Seller.
3. The customer is obliged to return the goods to the Seller, not later than within 14 calendar days from the date of submitting the return statement. In order to speed up the process of returning the payment, he has the option of sending the proof of sending back the goods to the Seller.
4. If the Customer does not provide proof of returning the goods, the Seller returns the payment made by the Customer only after the Seller has received the goods.
5. The Seller refunds the payment using the same method of payment as used by the Customer, unless the Customer expressly agreed to a different method of return, which does not involve any costs for him.
6. A statement of return can be submitted electronically using the RETURN FORM. To meet the deadline referred to in para. 1, it is enough to send the statement before its expiry.
7. The customer bears the costs of returning the goods to the Seller.
9. COMPLAINT PROCEDURE
1. In order to facilitate the Customer's complaint procedure, the Seller is liable under the warranty for defects in the goods purchased by the Customer. A complaint may be submitted by the Customer via e-mail to the following address: contact@jolmie.co.uk or in the form of a letter to the Seller's address. The Seller will respond to the Consumer's complaint within 14 working days from the moment of submitting the complaint.
2. The complaint referred to in par. 1, is considered on the basis of information provided by the Customer about the defects of the goods and their photos, without the need to send the goods to the Seller.
3. In the event of irregularities related to the functioning of the Seller's website, the Customer is entitled to report this fact by sending an e-mail to the address: contact@jolmie.co.uk or in the form of a letter to the Seller's address.
4. Any complaints regarding payments should be reported to the entity responsible for the payment, i.e. the bank or other entity through which the funds are transferred.
10. SELLER ASSESSMENT AND ORDER PROCESSING
1. On the jolmie.co.uk website, the Customer has the opportunity to evaluate the goods sold by the Seller. The assessment is made by completing a special form available on the website.
2. Ratings issued by the Customer are public and visible to other Customers.
3. Only verified customers can leave reviews on jolmie.co.uk.
4. A verified customer is a consumer who has verified his e-mail address and has purchased a product for which he wants to express an opinion.
11. PROCESSING OF PERSONAL DATA
1. Personal data is processed in accordance with the provisions of the Act of May 10, 2018 on the protection of personal data (Journal of Laws of 2018, item 1000, as amended).
2. By providing personal data, the Customer agrees to their processing by the Seller in order to properly perform the service.
3. The data entered in the registration form should be updated by the Customer. The data must be updated by changing the relevant data in the Customer's account.
4. The customer may also consent to the sending of commercial information by electronic means of communication. In the event of such consent, the Seller is entitled to send the Customer this content electronically.
5. Personal data provided in the application and/or registration form will be processed and administered by the Seller.
6. The customer has the right to access the content of personal data and the right to request their correction, supplementation or removal on the terms set out in art. 32-35 of the Personal Data Protection Act.
12. COPYRIGHT
1. The Seller's website is a work within the meaning of the Copyright Act and all copyrights are vested solely in the Seller.
2. The Seller declares that all materials posted on the Seller's website, including text, photographic, graphic materials and their arrangement, are the intellectual property of the Seller or third parties.
3. The Seller excludes the possibility of copying, duplicating, modifying, disseminating or other forms of commercial use of materials owned by the Seller, referred to in section 1, without the prior written consent of the Seller.
13. TECHNICAL REQUIREMENTS
1. In order to use the Seller's website, it is necessary for the Customer to have a computer or other end device with access to the Internet.
2. To use the Seller's website, it is required to enable short text messages called cookies (hereinafter: cookies). Disabling cookies prevents the Customer from taking full advantage of the Seller's website.
14. CHANGES TO THE REGULATIONS
1. The Broker reserves the right to introduce changes to these Regulations, which will be announced on the website immediately, i.e. no later than 14 days before the changes are introduced.
2. The Seller shall inform about the fact of amending the Regulations by posting on the Website information about the changes and posting the consolidated text of the amended Regulations and indicating which of the existing provisions of the Regulations have changed.
3. The Regulations may be changed at any time, in particular for important technical, legal and / or organizational reasons, without the need to justify these reasons.
4. The use of the Seller's services by the Customer after the entry into force of the changes to the Regulations is tantamount to acceptance of the changes.
5. Any changes to these Regulations come into force within 14 days from the date of their publication on the website.
15. FINAL PROVISIONS
1. These Regulations are made available to Customers free of charge, in a way that allows them to be obtained, reproduced and recorded.
2. These Regulations are available on the website in the Regulations tab.
3. Communication between the parties takes place electronically. The Seller will send the Customer information to the e-mail address provided during registration.
4. These Regulations come into force on the day of its publication on the website.
5. If one of the provisions of these Regulations is or will be ineffective, this does not affect the binding force of the remaining provisions. In place of the ineffective provision of the Regulations, the rule closest to the purposes of the invalid provision and the entire Regulations will apply.
6. Any disputes arising from the provision of services by the Seller will be settled amicably, and in the absence of an agreement, they will be settled by a common court of competent local and material jurisdiction.
7. The law applicable to all legal relationships arising from these Regulations is Polish law.
8. In matters not covered by these Regulations, generally applicable laws shall apply.
16. OUT OF COURT RESOLUTION
If the Customer is a consumer and the complaint procedure does not bring the result expected by the Customer, the Customer may use:
a) with a request for dispute resolution to a permanent amicable consumer court operating at the Trade Inspection with a request for dispute resolution,
b) a request to initiate mediation proceedings to the voivodship inspector of the Trade Inspection (more information on the website of the inspector competent for the place of business by the Seller),
c) free assistance of the poviat (municipal) consumer ombudsman or social organization whose statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers). Detailed information on the possibility for the Customer who is a consumer to use out-of-court complaint and redress methods and the rules of access to these procedures are available on the website of the Office of Competition and Consumer Protection.
